Thank you for visiting Detwiler Brewing. These Terms of Service (the “Terms”) govern your access to and use of our website, email and text communications, and any related services we provide (the “Services”). By using the Services you agree to these Terms.

If you do not agree, do not use the Services.

Who we are

Detwiler Brewing, located inside Stampede BBQ at 4372 Morgantown Rd, Mohnton, PA 19540, provides small-batch beer and related events and merchandise. References to “Detwiler,” “we,” “us,” or “our” mean Detwiler Brewing and our affiliates.

Age restrictions

You must be at least 21 years old to purchase alcohol, attend alcohol-focused events, or subscribe to our marketing messages, including SMS. If you are under 21, do not provide us with your phone number for marketing communications and do not purchase alcohol.

Changes to these Terms

We may update these Terms at any time. When we do, we will post the updated Terms on this page and update the effective date. Continued use of the Services after an update means you accept the revised Terms.

Website content and license

All content on the Services including text, logos, images, graphics and software is owned by us or our licensors and is protected by intellectual property laws. You may use the Services for your personal, noncommercial use only. Do not copy, modify, distribute, publicly display, or create derivative works from our content without written permission.

Acceptable use

You agree not to:

Use the Services for any unlawful purpose
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to bypass any security or access controls
Use the Services to harass, abuse, or harm others
Scrape or harvest information from the Services without written permission

Third party services and links

The Services may link to third party websites or services, including Stampede BBQ. We are not responsible for third party content, policies, or practices. Use third party sites at your own risk.

Events and on-premise policies

Event details, times, and performers may change. We reserve the right to refuse service to anyone who appears intoxicated or underage. You assume all risks related to attending any event or visiting our location. Follow posted rules and instructions from staff.

Orders, gift cards, and merchandise

If we offer online ordering of merchandise or gift cards, the following apply:

Prices and availability are subject to change without notice
Sales tax and shipping may apply
Some items may be final sale
We may cancel any order and issue a refund at our discretion
Title and risk of loss pass to you when we deliver the items to the carrier

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Services will be error free, secure, or available at all times.

Limitation of liability

To the fullest extent permitted by law, we and our owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred US dollars.

Indemnification

You agree to indemnify and hold harmless Detwiler Brewing and our owners, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the Services or your violation of these Terms or applicable law.

Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania without regard to conflict of law principles. You agree to submit to the personal jurisdiction of state and federal courts located in Pennsylvania for any dispute that is not subject to arbitration.

Dispute resolution and arbitration

At our sole discretion, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis. If arbitration is elected, you waive the right to a trial by jury or to participate in a class action. The arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules and, if applicable, the Supplementary Procedures for Consumer-Related Disputes. Judgment on the award may be entered in any court of competent jurisdiction. You may opt out of this arbitration provision by sending written notice to us within 30 days of first accepting these Terms.

Communications from us

When you provide your email address or phone number, you consent to receive communications, which may include marketing, transactional, and informational messages. You can opt out of marketing emails by using the unsubscribe link in the email. Transactional emails related to your purchases or account are required to provide the Services and you may not be able to opt out of those.

SMS and A2P Messaging Terms

This section applies to our text messaging programs and is intended to satisfy industry requirements for A2P messaging compliance.

Program name and description

Description: When you opt in, you may receive SMS or MMS messages about tap lists, events, special offers, limited releases, and updates related to Detwiler Brewing. Message frequency varies based on events and promotions.

Opt in consent

You may opt in using one or more of the following methods that we make available from time to time:

Web form or checkout checkbox next to your phone number field
Texting a join keyword that we provide
Paper or digital sign-up at our location
Point of sale or QR code opt in, where we display the required disclosures
By opting in, you represent that you are the owner or customary user of the phone number provided and that you are 21 or older. Do not enroll a phone number that is not yours. We may send a confirmation message after you enroll.

Opt out instructions

You can opt out at any time by replying STOP. You will receive a single confirmation message that your opt out was processed. After that, you will not receive further marketing texts from us unless you later re-enroll.

We also honor opt out requests sent to info@detwilerbrewing.com or by calling +1 484 798 4955, although texting STOP is the fastest way to stop messages.

The messaging program is intended for users who are 21 or older. Do not enroll if you are under 21.

Content standards

We will not send messages that promote excessive or irresponsible consumption, and we do not message about illicit substances or other prohibited content. We send messages only to recipients who have provided the appropriate consent.

Privacy

We respect your privacy. We use your phone number and message content to operate the messaging program and as described in our Privacy Policy at /privacy-policy. We do not sell your personal data. We may share limited information with our messaging service providers to deliver messages.

Changes and termination

We may change or end the messaging program or any of its features at any time without notice. If the program ends, we will stop sending messages.

Your obligations

Keep your contact information current and accurate. You are responsible for any charges from your carrier. Do not enroll with a phone number that is not yours. Do not use our messaging program to send unlawful or abusive content.

Severability

If any part of these Terms is held to be invalid or unenforceable, the remaining parts stay in effect.

Entire agreement

These Terms make up the entire agreement between you and us regarding the Services.
